Legal System failure?

An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.

That just sux...can't believe they have any right to sue him for keeping them off his own land.

If there are no trespassing signs up cant he do that to essentially anyone?

This is why illegals of all nationality want to come to the U.S. In mexico the rancher would shoot them (or whatever). Here you can sue for anything(and win)! Cant kill an intruder unless his actually in your home and poses a threat ie weapon! Detaining someone is almost kidnapping in they eyes of the law. BS!

if they are here illegally, and are stopped by the landowner, it seems doubly ridiculous. What if he detained a bunch of legal migrant workers? NOW they might have a case... But they shouldn't.

Like Mike said... Same thing happens in another country, and you'd be lucky not to spend the rest of your life in jail. What makes us great is that we're not like other countries... Let's hope the court gets this one right.

P.S. Are they suing from Mexico or from a US jail??

Well, heck....what did you expect from a place where we throw our own border patrol agents in prison for shooting a fleeing drug dealer in the rear end? :angry:

This is what kills me. Those border agents shot a FLEEING person. Not to say they were right or wrong, but when someone is running away and gets shot you must have an inquirey. Now you take a look at the cop who shot the military man who was on the ground obeying the officers orders. It shows him clearly shooting for NO REASON, and he is let go! Not to add fuel to the fire, just dont understand who can determine what is right and wrong anymore.

Each and every one of them should have been charged with a felony for knowingly breaking federal law and illegally entering the US. Along with that the ranch owner should also press trespassing charges against each and every one. Then them and their lawyer should be charged with filing a frivolous law suit. I think it is perfectly legal to make a citizens arrest when you witness someone committing a crime, whether it is on your property or not.

If I remember right, the border patrol agents thought he was going for a weapon and he had been fighting at least one of them. He was not just running away. He got across back into Mexico so no weapon could be recovered. Where they really screwed up was trying to avoid writing a report of the incident. They had no suspect and did think they had hit him so they thought they could get away from writer’s cramp and all the bull$&it red tape by just hiding the fact that the incident happened. Who knows if he was shot by them or someone else? He is a drug runner and his own relatives say he is always armed.

Personally I think he did pull out a gun. The two agents messed up by not filling out a shooting report. That is an administrative violation, something that might get them fired but not thrown in prison.

I don’t know anything about the wrongful shooting of a military man so I can’t comment on that.

As for this case of the Rancher down in Arizona it is just craziness. Have we gotten so bad that we can’t keep people from cutting our fences, killing our livestock and threatening us? This is the same as someone who kicks down your fence and kills your dog. Don’t you have a right to stop them and hold them for authorities? The rancher had a long history of damage to his property and being threatened by drug and people smugglers.

This country is getting worse and worse, and it's our representatives that get voted into power who are screwing it up. Too many spineless and complacent people out there.

At least Bush stood up before he left office and commuted their sentence, they should be out next month.
